    Frequently Asked Questions About Improperly Licensed Contractors

    If my contractor was on the list of illegally licensed contractors is my permit valid?

    Each permit will be evaluated individually, with building officials making a final determination. Contact the building official PDF  responsible for building projects in your municipality. The licenses of illegally licensed contractors have been revoked.


    If my contractor was on the list of illegally licensed contractors are my inspections valid?

    Although there may be exceptions, invalid permits may require a change to a licensed contractor or the property owner for your protection. If you live within the unincorporated areas of Miami-Dade County, the city of West Miami or the Town of Cutler Bay, you will receive a letter from the Miami-Dade County Building Department providing specific instructions regarding the permit.  If you live in a municipality other than the above stated, please contact your local building official PDF for inspection information.


    The contractor is working on my house right now. Should I let him/her keep working or call the police?

    Do not alert the illegally licensed contractor; call the Miami-Dade County
    3-1-1 Answer Center and obtain a  Initial Complaint Intake Form PDF. After the complaint has been filed, ask the contractor to discontinue working until further notice. Miami-Dade County will notify the contractor to cease construction.


    If I owe the illegally licensed contractor money, should I pay him/her?

    No. According to Florida Statute FS489.128 contracts with unlicensed contractors are unenforceable.


    Do I have to get another contractor to finish the work?

    Yes. It is recommended that a properly licensed contractor assumes the construction responsibilities. Your building official PDF  can assist in the permit transfer process.


    Should I file a contractor complaint?

    Yes. It is to your advantage to report the problem using a Initial Complaint Intake Form PDF. Return the completed form as soon as possible to:

    Upon receipt of the completed Initial Complaint Intake Form, a Code Compliance Investigator will open a case file and contact you in order to begin processing your complaint. When the initial investigation is complete, you may be required to complete a Contractor Complaint Affidavit PDF.  The Contractor Complaint Affidavit will be used by the Construction Trades Qualifying Board to assess restitution based on verifiable damages supported by the documentation you provide.

    If you have already submitted a Contractor Complaint Affidavit, or if you choose to submit a Contractor Complaint Affidavit, you do not need to submit an Initial Complaint Intake Form. In this case, you will be contacted by a Building Code Compliance Office Investigator after preliminary review of the affidavit.
