Who can Appeal?
Only an aggrieved party of record may file an appeal.
Certain Community Zoning Appeals Board decisions on items such as Zone Changes, certain Use Variances and certain Appeals of Administrative Decision are appealable to the Board of County Commissioners.
***To determine if an item is appealable to the Board of County Commissioners, check the posting notice on the bulletin board located at the front of the 11th floor of the Stephen P. Clark Center or call the Zoning Hearings Section at (305) 375-2640.
All other items may only be appealed to Circuit Court. For Circuit Court appeal periods, please call our Legal Counsel's office at (305) 375-3075.
If the file is appealable to the County Commission, the appeal period begins the Monday after the Community Zoning Appeals Board's hearing and lasts two weeks.
If your item is appealable to the Board of County Commissioners, you or an aggrieved party may file the appeal with the Zoning Hearings Section, along with the appropriate appeal filing fee. You will also be required to pay the radius fee either at the time of filing or at a later date if applicable. A transcript of the hearing will be ordered and, once received, the item will be scheduled on the next available County Commission agenda. In most cases, your appeal will be heard within two months of filing.
